Executive Bylaw of Articles 38 and 42 of the Electronic Commerce Law
The Council of Ministers, at its session dated 1383/10/9, upon the joint proposal of the Ministries of Commerce, Economic Affairs and Finance, the Management and Planning Organization of the country, and the Central Bank of the Islamic Republic of Iran, pursuant to Letter No. 18993/1 dated 1383/9/25 of the Ministry of Commerce, and in accordance with Clause "a" of Article (79) of the Electronic Commerce Law adopted in 1382, approved the following:
Article 1- In the following cases, due to the special conditions of the goods and services, the consumer shall not have the right of withdrawal as set forth in Clause "d" of Article (38) of the Electronic Commerce Law, unless the parties agree otherwise:
a) In the case of services, where, with the consumer's agreement, the provision thereof has commenced before the end of seven working days.
b) The provision of services for the delivery of foodstuffs or other goods intended for daily consumption.
c) Goods or services whose price is determined by fluctuations in the financial markets and is beyond the supplier's control.
d) Goods manufactured according to the consumer's individual specifications, which clearly bear a personal character, or which, due to their nature, cannot be returned, or which are liable to rapid deterioration or spoilage.
f) Packaged audio and video tapes and computer software that have been opened by the consumer.
e) Newspapers, publications, and magazines as defined by the Press Law.
Note - The Consumer and Producer Protection Organization is required to prepare a list of instances of the goods and services referred to in Clause "c" of this Article and, while keeping the information up to date, to make it known to the public through the national comprehensive commercial information network and the website of the said Organization.
Article 2- The following financial services, referred to in Clause "a" of Article (42) of the Electronic Commerce Law, are excluded from the scope of the consumer protection rules:
a - Investment-related services b - Insurance services c - Services of other financial and credit institutions
